Terms & Conditions

Welcome to Sublimation Studio (the “Company”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website located at sublimationstudio.ca (the “Site”) and your purchase of products and services from the Site. By accessing or using the Site, placing an order, or otherwise interacting with our services, you agree to be bound by these Terms. If you do not agree, do not use the Site or place an order.

2. Orders & acceptance

All orders are subject to acceptance by Sublimation Studio. Order acceptance and completion of the contract between you and Sublimation Studio will take place when we send you an order confirmation email that confirms we have accepted your order and taken payment (if applicable).

We reserve the right to refuse or cancel any order for reasons including but not limited to: product availability, errors in product information or pricing, suspected fraud, or inability to obtain authorization for payment.

3. Pricing & payment

Prices shown on the Site are quoted in Canadian Dollars (CAD) and exclude applicable taxes, duties and shipping costs unless otherwise stated. We try to ensure prices and product information are accurate; however errors may occur. If a pricing error is discovered after you place an order, we will either contact you for instructions or cancel the order and issue a refund.

Payment is due at the time of order. We accept the payment methods listed on the Site (for example: Visa, Mastercard, American Express, PayPal, Apple Pay). We do not store full card details on our servers — payment processing is handled by third-party gateways.

4. Product descriptions & images

We make every effort to display product images and descriptions accurately. However, product colours and final appearance may vary slightly from images due to screen settings, fabric or substrate differences, and the sublimation printing process. Images are for illustration purposes only unless the product listing states otherwise.

5. Custom artwork, uploads & customer warranties

When you upload artwork, logos, photos, or other materials (collectively “Customer Materials”), you warrant that you have all necessary rights, licenses, or permissions to use and reproduce those Customer Materials for the order, including third-party intellectual property rights. You further warrant that use of Customer Materials will not violate any applicable law, defame any person, or infringe any third-party rights.

You agree to indemnify and hold Sublimation Studio harmless from any claim, loss, liability or expense (including legal fees) arising from or related to Customer Materials you provide. We reserve the right to refuse to print any material that we reasonably believe infringes a third-party right or violates these Terms.

6. Production, shipping & delivery

Production times, shipping carriers and delivery estimates are provided on the Site and may vary by product and order volume. Shipping and handling charges are shown at checkout. Title and risk of loss pass to you according to the carrier’s terms once the order is picked up by the carrier.

Please review our Shipping Policy for full details. If a package is returned to us due to incorrect shipping information provided by you, re-shipment will be at your expense.

7. Returns, refunds & replacements

Because many of our products are custom-printed to order, returns for “change of mind” are generally not accepted. Please review our Refund & Returns Policy for detailed information on damaged, defective or incorrect items and how to request replacements or refunds.

8. Intellectual property

The Site and its content (including text, graphics, logos, images, and code) are protected by copyright, trademark and other intellectual property laws and are owned or licensed by Sublimation Studio or our partners. You may not copy, reproduce, distribute, create derivative works from, or publicly display our content except as permitted by these Terms or with our prior written permission.

9. User accounts

If you create an account on the Site you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

10. Prohibited uses

You must not use the Site or our services for unlawful, abusive or infringing purposes. Prohibited uses include (but are not limited to): uploading infringing or unlawful content, attempting to gain unauthorized access to the Site, interfering with security features, or using the Site to transmit malicious code.

11. Limitation of liability

To the fullest extent permitted by applicable law, Sublimation Studio and its officers, directors, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill arising out of or related to your use of the Site or products purchased from the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability for direct damages arising out of or related to these Terms or your purchase is limited to the purchase price paid by you for the specific order giving rise to the claim.

12. Disclaimer of warranties

The Site and all products and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by law.

13. Taxes

You are responsible for paying any sales taxes, duties or customs fees applicable to your order. Where applicable, Canadian sales tax (GST/HST/PST/QST) will be applied at checkout based on the shipping address.

14. Privacy & cookies

Our Privacy Policy and Cookie Notice explain how we collect and use personal information when you use our Site and services. By using the Site, you consent to those practices.

15. Promotions, coupons & gift cards

Promotional offers, coupons and gift cards are subject to the terms of the specific offer. We may limit the use of discounts or promotions, and we reserve the right to cancel promotional codes that were issued in error or used fraudulently.

16. Affiliate & referral programs

If we operate an affiliate or referral program, separate program terms may apply. We reserve the right to modify or terminate any affiliate or referral program at any time.

17. Force majeure

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, supply-chain disruptions, acts of government, or carrier delays. In such circumstances, production and delivery timelines may be extended.

18. Termination

We may suspend or terminate your access to the Site or services at any time, with or without cause and with or without notice, including for breach of these Terms. Termination does not affect rights or liabilities that accrued prior to termination.

19. Governing law & dispute resolution

These Terms and any dispute arising out of or relating to them or your use of the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You and Sublimation Studio agree to submit to the exclusive jurisdiction of the courts of Ontario in the event of any dispute, subject to mandatory consumer protection rights that cannot be excluded by law.

20. Changes to these Terms

We may modify these Terms from time to time. When material changes are made, we will post the updated Terms on the Site with a new effective date and, where appropriate, notify you by email. Continued use of the Site after changes constitutes acceptance of the revised Terms.

21. Communications & marketing consent (CASL)

By providing your email address or subscribing to our newsletter you consent to receive marketing communications from Sublimation Studio. You may withdraw consent at any time by using the unsubscribe link in our emails or contacting us. We comply with the Canadian Anti-Spam Legislation (CASL) and will not send you commercial electronic messages without consent.
